Michael Jordan Testifies He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, revealing he put in $40m of his personal wealth into the Cup Series operation launched with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”

Central Issue: Charter Agreements and Renewal Demands

The heart of the case involves the end of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for an hour and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a picture of the sports legend.

Spearheading the Fight

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.

For Jordan and and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a frantic and emotional period where the sanctioning body informed teams they had to sign a charter agreement extension. The document consists of over a hundred pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that his team and its ally concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

But in the end, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.

“Hamlin persuaded me adding a third car improved our chances to win,” he testified, sharing that he purchased another franchise last year for $28 million despite the uncertainty. “So I dove in.”

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She said the pressure of the contract signing demand didn’t sit well.

She said, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
